Our Role as Data Processor:

In our interactions with customers, Focalx acts strictly as a data processor. This means we process data on behalf of our B2B clients, who are the data controllers. Our activities are always aligned with the instructions and guidelines provided by our customers, and we are dedicated to handling data in accordance with these directives and applicable data protection laws.

For Mobile App Users:

If you are a user of our mobile application, whether as an employee of our direct client or as a customer using the app through our client’s services, please note that your use of the app falls under the data management policies of the organization that is our client. We recommend that you review the relevant privacy policy of your employer or the company providing you with access to our app, in conjunction with this document. Our role with respect to your data is to process it as instructed by our client, whether your employer or the service provider you engage with. We are committed to ensuring that your privacy rights are upheld and safeguarded in accordance with both our policy and the policy of the organization through which you access our services.

The following sections of this Privacy Policy detail how we at Focalx handle and protect data, our commitment to security, and our practices in compliance with relevant data protection regulations, including the General Data Protection Regulation (GDPR). We are committed to transparency in our data processing activities and to safeguarding the privacy of all data entrusted to us by our clients.

  • We process personal data on the following basis:
  • Article 6(1)(a) of the General Data Protection Regulation (GDPR) for consent.
  • Article 6(1)(f) of the GDPR as necessary for the purposes of the legitimate interests pursued by us. Our legitimate interests include providing the services you request and further developing the services in regards to the user and system functionality, etc.

Data Sharing and Disclosure:

Sub-processors are used under the agreement, with entities like Amazon Web Services (AWS), Intercom, Inc., and Mixpanel International, Inc. being approved sub-processors. Specific conditions apply to the engagement of sub-processors, including the requirement for prior general written authorization from the data controller and a 30-day notice period for any changes.

Data Security and Confidentiality:

The data processor is obligated to maintain the confidentiality of personal data and to implement appropriate technical and organizational security measures. We have provisions for notifying the data controller of any personal data breaches and for assisting in mitigating any potential damage.

International Data Transfers:

Transfers of personal data to third countries or international organizations are to be conducted only based on documented instructions from the data controller and in compliance with Chapter V of the GDPR.

Mobile App Users’ Rights:

Mobile app users have the right to request access to, rectification of, or erasure of their personal data. They also have the right to object to the processing of their personal data and to have the processing of their personal data restricted. In particular, mobile app users have an absolute right to object to the processing of their personal data for direct marketing purposes. If the processing of their personal data is based on their consent, they have the right to withdraw their consent at any time; however, such withdrawal shall not affect the lawfulness of the processing carried out prior to withdrawing consent. Mobile app users have the right to receive their personal data in a structured, commonly used, and machine-readable format (data portability). They also have the right to lodge a complaint with a data protection supervision authority, such as the Danish Data Protection Agency (Datatilsynet), at any time. Data Controller’s Rights and Obligations:

The data controller has the right and obligation to make decisions about the purposes and means of processing personal data. The data controller is responsible for ensuring that the processing has a legal basis and complies with the GDPR.

Data Processor’s Role and Instructions:

The data processor, Focalx Aps, processes personal data solely based on documented instructions from the data controller. The data processor must inform the data controller if any instructions contravene the GDPR or other applicable data protection provisions.

Audit and Inspection:

Provisions are in place for the data controller to conduct audits and inspections to ensure compliance with the GDPR and data processing obligations.

Changes to the Privacy Policy:

In the event of any changes to this Privacy Policy, Focalx customers will receive an email or be notified by push message through the app according to the changes.
