FocalX ApS (“focalx”) concede a voc\u00ea uma licen\u00e7a n\u00e3o exclusiva e intransfer\u00edvel para o uso do software e documenta\u00e7\u00e3o que o acompanham (coletivamente “Software”)<\/p>\n
O Software \u00e9 protegido por direitos de propriedade intelectual. O t\u00edtulo do Software e todos os direitos de propriedade intelectual associados, incluindo, sem limita\u00e7\u00e3o, quaisquer modifica\u00e7\u00f5es, melhorias e revis\u00f5es do Software, s\u00e3o retidos pela focalx e\/ou seus licenciadores. A menos que a aplica\u00e7\u00e3o seja proibida pela lei aplic\u00e1vel, voc\u00ea n\u00e3o pode modificar, descompilar ou fazer engenharia reversa do Software. Nenhum direito, t\u00edtulo ou interesse em ou para qualquer marca registrada, marca de servi\u00e7o, logotipo ou nome comercial da focalx ou de seus licenciadores \u00e9 concedido sob este Contrato. <\/p>\n
O Software \u00e9 fornecido “COMO EST\u00c1”. Sem limitar o exposto, a focalx n\u00e3o garante que o Software esteja livre de erros ou funcionar\u00e1 sem bugs, v\u00edrus, perda de dados ou interrup\u00e7\u00f5es. Seu recurso exclusivo e a responsabilidade total da focalx sob esta garantia limitada ser\u00e1 a substitui\u00e7\u00e3o do Software pela focalx. Todas as condi\u00e7\u00f5es, representa\u00e7\u00f5es e garantias expressas ou impl\u00edcitas, incluindo qualquer garantia impl\u00edcita de comercializa\u00e7\u00e3o, adequa\u00e7\u00e3o a uma finalidade espec\u00edfica ou n\u00e3o viola\u00e7\u00e3o s\u00e3o rejeitadas pela focalx, exceto na medida em que essas isen\u00e7\u00f5es sejam consideradas legalmente inv\u00e1lidas. <\/p>\n
NA MEDIDA EM QUE N\u00c3O SEJA PROIBIDO POR LEI, EM NENHUMA CIRCUNST\u00c2NCIA A FOCALX OU SEUS LICENCIADORES SER\u00c3O RESPONS\u00c1VEIS POR QUALQUER PERDA DE RECEITA, LUCRO OU DADOS, OU POR DANOS ESPECIAIS, INDIRETOS, CONSEQUENCIAIS, INCIDENTAIS OU PUNITIVOS, INDEPENDENTEMENTE DA CAUSA E DA TEORIA DE RESPONSABILIDADE, DECORRENTES DO USO OU DA INCAPACIDADE DE USAR O SOFTWARE, MESMO QUE A FOCALX TENHA SIDO AVISADA DA POSSIBILIDADE DE TAIS DANOS. EM NENHUMA CIRCUNST\u00c2NCIA A RESPONSABILIDADE DA FOCALX PARA COM VOC\u00ca, SEJA EM CONTRATO, RESPONSABILIDADE CIVIL (INCLUINDO NEGLIG\u00caNCIA) OU DE OUTRA FORMA, EXCEDER\u00c1 O VALOR PAGO POR VOC\u00ca PELO SOFTWARE SOB ESTE CONTRATO. AS LIMITA\u00c7\u00d5ES ANTERIORES SE APLICAR\u00c3O MESMO QUE A GARANTIA ACIMA DECLARADA FALHE EM SEU PROP\u00d3SITO ESSENCIAL. <\/p>\n
Este Contrato \u00e9 efetivo at\u00e9 ser rescindido. Voc\u00ea pode rescindir este Contrato a qualquer momento desinstalando o Software e destruindo todas as c\u00f3pias do Software. Este Contrato ser\u00e1 rescindido imediatamente sem aviso pr\u00e9vio da focalx se voc\u00ea n\u00e3o cumprir qualquer disposi\u00e7\u00e3o deste Contrato. Ap\u00f3s a rescis\u00e3o, voc\u00ea deve desinstalar o Software e destruir todas as c\u00f3pias do Software. <\/p>\n

Exceto conforme contido neste aviso, o nome de um detentor de direitos autorais n\u00e3o deve ser usado em publicidade ou de outra forma para promover a venda, uso ou outras negocia\u00e7\u00f5es neste Software sem autoriza\u00e7\u00e3o pr\u00e9via por escrito do detentor dos direitos autorais.<\/p>\n
