ACCORD DE LICENCE<\/h1>

focalx, Version (Tous)<\/h2>

Lisez attentivement les termes de ce contrat de licence et toute condition de licence suppl\u00e9mentaire fournie avant l’installation (collectivement \u00ab\u00a0Contrat\u00a0\u00bb). En cas de contradiction entre le pr\u00e9sent contrat de licence et les conditions de licence suppl\u00e9mentaires fournies, les conditions de licence suppl\u00e9mentaires pr\u00e9vaudront. Le logiciel auquel s’applique le pr\u00e9sent contrat est prot\u00e9g\u00e9 par la loi sur les droits d’auteur et d’autres lois, r\u00e8glements et accords internationaux sur la propri\u00e9t\u00e9 intellectuelle. En installant, en utilisant ou en copiant le logiciel, vous acceptez d’\u00eatre li\u00e9 par les termes de ce contrat.<\/p>

1. LICENCE D’UTILISATION :<\/h2>

FocalX ApS (\u00ab\u00a0focalx\u00a0\u00bb) vous accorde une licence non exclusive et non transf\u00e9rable pour l’utilisation du logiciel et de la documentation qui l’accompagnent (collectivement le \u00ab\u00a0Logiciel\u00a0\u00bb)<\/p>

2. RESTRICTIONS :<\/h2>

Le logiciel est prot\u00e9g\u00e9 par des droits de propri\u00e9t\u00e9 intellectuelle. Le titre du logiciel et tous les droits de propri\u00e9t\u00e9 intellectuelle associ\u00e9s, y compris, mais sans s’y limiter, toutes les modifications, am\u00e9liorations et r\u00e9visions du logiciel, sont conserv\u00e9s par focalx et\/ou ses conc\u00e9dants de licence. Sauf si l’ex\u00e9cution est interdite par la loi applicable, vous ne pouvez pas modifier, d\u00e9compiler ou d\u00e9sosser le logiciel. Aucun droit, titre ou int\u00e9r\u00eat sur une marque, une marque de service, un logo ou un nom commercial de focalx ou de ses conc\u00e9dants n’est accord\u00e9 dans le cadre de cet accord.<\/p>

3. EXCLUSION DE GARANTIE :<\/h2>

Le logiciel est fourni \u00a0\u00bb en l’\u00e9tat \u00ab\u00a0. Sans limiter ce qui pr\u00e9c\u00e8de, focalx ne garantit pas que le Logiciel est exempt d’erreurs ou qu’il fonctionnera sans bogues, virus, pertes de donn\u00e9es ou interruptions. Votre seul recours et l’enti\u00e8re responsabilit\u00e9 de focalx dans le cadre de cette garantie limit\u00e9e sera le remplacement du Logiciel par focalx. Toutes les conditions, repr\u00e9sentations et garanties expresses ou implicites, y compris toute garantie implicite de qualit\u00e9 marchande, d’ad\u00e9quation \u00e0 un usage particulier ou d’absence de contrefa\u00e7on sont rejet\u00e9es par focalx, sauf dans la mesure o\u00f9 ces clauses de non-responsabilit\u00e9 sont consid\u00e9r\u00e9es comme l\u00e9galement invalides.<\/p>

4. LIMITATION DE LA RESPONSABILIT\u00c9 :<\/h2>

DANS LA MESURE OU LA LOI NE L’INTERDIT PAS, FOCALX OU SES CONC\u00c9DANTS DE LICENCE NE SERONT EN AUCUN CAS RESPONSABLES DES PERTES DE REVENUS, DE PROFITS OU DE DONN\u00c9ES, OU DES DOMMAGES SP\u00c9CIAUX, INDIRECTS, CONS\u00c9CUTIFS, ACCESSOIRES OU PUNITIFS, QUELLE QU’EN SOIT LA CAUSE ET QUELLE QUE SOIT LA TH\u00c9ORIE DE LA RESPONSABILIT\u00c9, R\u00c9SULTANT DE OU LI\u00c9S \u00c0 L’UTILISATION OU \u00c0 L’INCAPACIT\u00c9 D’UTILISER LE LOGICIEL, M\u00caME SI FOCALX A \u00c9T\u00c9 AVERTI DE LA POSSIBILIT\u00c9 DE TELS DOMMAGES. EN AUCUN CAS, LA RESPONSABILIT\u00c9 DE FOCALX ENVERS VOUS, QU’ELLE SOIT CONTRACTUELLE, D\u00c9LICTUELLE (Y COMPRIS LA N\u00c9GLIGENCE) OU AUTRE, NE D\u00c9PASSERA LE MONTANT QUE VOUS AVEZ PAY\u00c9 POUR LE LOGICIEL DANS LE CADRE DE CE CONTRAT. LES LIMITATIONS PR\u00c9C\u00c9DENTES S’APPLIQUENT M\u00caME SI LA GARANTIE SUSMENTIONN\u00c9E NE REMPLIT PAS SON OBJECTIF ESSENTIEL.<\/p>

5. R\u00c9SILIATION :<\/h2>

Le pr\u00e9sent accord est valable jusqu’\u00e0 ce qu’il soit r\u00e9sili\u00e9. Vous pouvez r\u00e9silier ce Contrat \u00e0 tout moment en d\u00e9sinstallant le Logiciel et en d\u00e9truisant toutes les copies du Logiciel. Le pr\u00e9sent accord sera r\u00e9sili\u00e9 imm\u00e9diatement sans pr\u00e9avis de la part de focalx si vous ne vous conformez pas \u00e0 l’une des dispositions du pr\u00e9sent accord. Lors de la r\u00e9siliation, vous devez d\u00e9sinstaller le logiciel et d\u00e9truire toutes les copies du logiciel.<\/p>

\u00c0 l’exception de ce qui est indiqu\u00e9 dans le pr\u00e9sent avis, le nom d’un d\u00e9tenteur de droits d’auteur ne doit pas \u00eatre utilis\u00e9 \u00e0 des fins publicitaires ou pour promouvoir la vente, l’utilisation ou d’autres op\u00e9rations relatives \u00e0 ce logiciel sans l’autorisation \u00e9crite pr\u00e9alable du d\u00e9tenteur des droits d’auteur.<\/p>
