ACUERDO DE LICENCIA<\/h1>\n\n

focalx, Versi\u00f3n (Todos)<\/h3>\n\n

Lee atentamente los t\u00e9rminos de este acuerdo de licencia y los t\u00e9rminos de licencia suplementarios proporcionados antes de la instalaci\u00f3n (colectivamente \u00abAcuerdo\u00bb ). En caso de contradicci\u00f3n entre este acuerdo de licencia y los t\u00e9rminos de licencia suplementarios proporcionados, prevalecer\u00e1n los t\u00e9rminos de licencia suplementarios. El software al que se aplica este Acuerdo est\u00e1 protegido por la ley de derechos de autor y otras leyes, normativas y acuerdos internacionales sobre propiedad intelectual. Al instalar, utilizar o copiar el software, aceptas quedar vinculado por los t\u00e9rminos de este Acuerdo. <\/p>\n\n

1. LICENCIA DE USO:<\/h3>\n\n

FocalX ApS (\u00abfocalx\u00bb) te concede una licencia no exclusiva e intransferible para el uso del software y la documentaci\u00f3n adjuntos (colectivamente \u00abSoftware\u00bb)<\/p>\n\n

2. RESTRICCIONES:<\/h3>\n\n

El Software est\u00e1 protegido por derechos de propiedad intelectual. La titularidad del Software y de todos los derechos de propiedad intelectual asociados, incluyendo, sin limitaci\u00f3n, cualquier modificaci\u00f3n, mejora y revisi\u00f3n del Software, corresponde a focalx y\/o a sus licenciantes. A menos que su aplicaci\u00f3n est\u00e9 prohibida por la legislaci\u00f3n aplicable, no podr\u00e1s modificar, descompilar ni aplicar ingenier\u00eda inversa al Software. En virtud del presente Contrato no se concede ning\u00fan derecho, t\u00edtulo o inter\u00e9s sobre ninguna marca comercial, marca de servicio, logotipo o nombre comercial de focalx o sus licenciantes. <\/p>\n\n

3. EXCLUSI\u00d3N DE GARANT\u00cdAS:<\/h3>\n\n

El Software se proporciona \u00abTAL CUAL\u00bb. Sin perjuicio de lo anterior, focalx no garantiza que el Software est\u00e9 libre de errores o funcione sin fallos, virus, p\u00e9rdida de datos o interrupciones. Tu \u00fanico remedio y toda la responsabilidad de focalx en virtud de esta garant\u00eda limitada ser\u00e1 la sustituci\u00f3n del Software por focalx. focalx renuncia a todas las condiciones, declaraciones y garant\u00edas expresas o impl\u00edcitas, incluida cualquier garant\u00eda impl\u00edcita de comerciabilidad, idoneidad para un fin determinado o no infracci\u00f3n, salvo en la medida en que estas renuncias se consideren legalmente inv\u00e1lidas. <\/p>\n\n

4. LIMITACI\u00d3N DE RESPONSABILIDAD:<\/h3>\n\n

EN LA MEDIDA EN QUE NO LO PROH\u00cdBA LA LEY, EN NING\u00daN CASO FOCALX O SUS LICENCIANTES SER\u00c1N RESPONSABLES DE NINGUNA P\u00c9RDIDA DE INGRESOS, BENEFICIOS O DATOS, NI DE DA\u00d1OS ESPECIALES, INDIRECTOS, CONSECUENTES, INCIDENTALES O PUNITIVOS, INDEPENDIENTEMENTE DE LA TEOR\u00cdA DE RESPONSABILIDAD, QUE SURJAN O EST\u00c9N RELACIONADOS CON EL USO O LA INCAPACIDAD DE USAR EL SOFTWARE, INCLUSO SI FOCALX HA SIDO ADVERTIDO DE LA POSIBILIDAD DE DICHOS DA\u00d1OS. EN NING\u00daN CASO LA RESPONSABILIDAD DE FOCALX ANTE TI, YA SEA CONTRACTUAL, EXTRACONTRACTUAL (INCLUIDA LA NEGLIGENCIA) O DE OTRO TIPO, SUPERAR\u00c1 EL IMPORTE PAGADO POR TI POR EL SOFTWARE EN VIRTUD DEL PRESENTE CONTRATO. LAS LIMITACIONES ANTERIORES SE APLICAR\u00c1N INCLUSO EN EL CASO DE QUE LA GARANT\u00cdA INDICADA ANTERIORMENTE NO CUMPLA SU FINALIDAD ESENCIAL. <\/p>\n\n

5. RESCISI\u00d3N:<\/h3>\n

Este Acuerdo es efectivo hasta su rescisi\u00f3n. Puedes rescindir el presente Contrato en cualquier momento desinstalando el Software y destruyendo todas las copias del mismo. El presente Contrato se rescindir\u00e1 inmediatamente sin previo aviso por parte de focalx si no cumples alguna de sus disposiciones. Tras la Rescisi\u00f3n, deber\u00e1s desinstalar el Software y destruir todas las copias del mismo. <\/p>\n\n

EN NING\u00daN CASO LOS AUTORES O LOS TITULARES DE LOS DERECHOS DE AUTOR SER\u00c1N RESPONSABLES DE NINGUNA RECLAMACI\u00d3N, DA\u00d1O U OTRA RESPONSABILIDAD, YA SEA EN UNA ACCI\u00d3N CONTRACTUAL, EXTRACONTRACTUAL O DE OTRO TIPO, QUE SURJA DE, O EST\u00c9 RELACIONADA CON EL SOFTWARE O EL USO U OTRAS OPERACIONES CON EL SOFTWARE. <\/p>\n\n

A excepci\u00f3n de lo contenido en este aviso, el nombre del titular de los derechos de autor no se utilizar\u00e1 en la publicidad o de otro modo para promover la venta, uso u otras transacciones de este Software sin la autorizaci\u00f3n previa por escrito del titular de los derechos de autor.<\/p>\n\n
